Terms and Conditions

Article 1: Definitions and Applicability

1. Pocket Experiences: located at Monnikenpad 21, 5505 KR Veldhoven, registered with the Chamber of Commerce (KVK) under number 97971286, with VAT identification number NL005369928B06.
2. Customer: any natural person or legal entity who enters into an agreement with Pocket Experiences.
3. Product: the digital audio tours and experiences offered by Pocket Experiences.
4. These terms and conditions apply to every offer from Pocket Experiences and to every agreement concluded between Pocket Experiences and the Customer.
5. The use of our website and mobile application is also subject to our Privacy Policy and your cookie preferences, which describe how we collect and use your personal data.

Article 2: Offer and Agreement

1. The agreement is concluded the moment the Customer completes the payment via the website.
2. Payment is made directly and in full prior to delivery via the payment methods offered by Stripe.

Article 3: Delivery

1. Delivery of the Product takes place by means of an email to the email address provided by the Customer.
2. This email contains the order details and the instructions or codes to activate and download the Product.
3. Pocket Experiences aims to send this email immediately after successful payment. Any delays in sending or receiving, caused by external factors, cannot be attributed to Pocket Experiences.

Article 4: Exclusion of Right of Withdrawal

1. The statutory right of withdrawal (cooling-off period) is excluded for the digital Products of Pocket Experiences.
2. The delivery of the digital Product starts immediately after payment is completed.
3. By placing the order, the Customer explicitly agrees to the immediate delivery and also explicitly waives his or her right of withdrawal.

Article 5: License and Experience Availability

1. Each purchased experience is licensed to the Customer for personal, non-transferable use. The Product is meant for the Customer's personal enjoyment and may not be shared with others.
2. Once purchased, the Customer may use and replay an experience as many times as they like, at no additional cost.
3. Under normal circumstances, purchased experiences remain available in the Customer's library and downloadable for as long as Pocket Experiences operates. Pocket Experiences only removes an experience from a Customer's library in exceptional circumstances, such as when required by law, due to copyright or licensing issues, or when content becomes factually incorrect or unsafe.
4. Pocket Experiences may retire experiences from the public store at any time, for example to maintain a consistently high-quality offering and to avoid outdated content as the platform evolves. A retired experience is no longer available for new purchases, but Customers who already purchased it retain access.

Article 6: Warranty and Conformity

1. Pocket Experiences guarantees that the Products function correctly technically on common, reasonably up-to-date iOS and Android devices that are still supported by their respective manufacturers.
2. It is the Customer's responsibility to download the Product before use.
3. If a Product does not function properly, the Customer must contact info@pocketexperiences.com. Pocket Experiences will endeavor to solve the problem, for example by generating a new activation code. If the problem cannot be solved and the Product is therefore unusable, the Customer is entitled to a refund of the purchase price.

Article 7: Liability

1. The use of the Products of Pocket Experiences is entirely at the Customer's own risk.
2. Pocket Experiences is in no way liable for any form of damage (direct, indirect, material, immaterial, injury or otherwise) that the Customer suffers during or as a result of using the Product.
3. The Customer is and remains at all times responsible for his or her own safety and the safety of others. This includes, but is not limited to, paying attention in traffic, complying with local laws and regulations, and following instructions from local authorities.
4. The Products are intended as an enrichment of an experience and should not be regarded as a guide that takes over the Customer's responsibility.
5. If Pocket Experiences is nevertheless held liable, the total liability is at all times limited to a maximum of the purchase amount of the relevant Product.

Article 8: Force Majeure

In the event of force majeure, such as large-scale disruptions of the internet, servers or external services, Pocket Experiences is not obliged to fulfill its obligations to the Customer.

Article 9: Applicable Law and Disputes

1. All agreements between Pocket Experiences and the Customer are exclusively governed by Dutch law.
2. Disputes will be submitted to the competent court in the Netherlands.

Article 10: Complaints Procedure

1. For complaints, the Customer can contact Pocket Experiences via info@pocketexperiences.com.
2. We aim to provide a substantive response to the complaint within 5 working days of receipt.
3. If we need more time to handle the complaint, we will inform the Customer within 5 working days, stating the reason for the delay and an indication of when a response can be expected.
4. We are not affiliated with an external disputes committee.

Article 11: Promotions, Coupons, and Discount Codes

1. Coupons: coupons provided by Pocket Experiences are intended for redemption within the Pocket Experiences mobile application to unlock specific audio tours. The method and location for redemption within the app may change over time.
2. Discount Codes: from time to time, Pocket Experiences may offer promotional discount codes. These codes can be applied during the checkout process on the website or in the mobile app, as specified by the promotion.
3. General conditions: all promotions, coupons, and discount codes are subject to the following:
   • They are valid for a limited time only, and Pocket Experiences reserves the right to modify or cancel them at any time.
   • They may have specific terms and conditions, such as limitations on the number of uses or applicability to certain products.
   • They have no cash value and cannot be exchanged for cash or credit.
   • They may not be combined with other offers unless explicitly stated otherwise.

Article 12: Amendment of the Terms

Pocket Experiences reserves the right to change these terms and conditions at any time. The most recent version is always available on the website.
